Enron Scandal Essay

Accounting scandals are political or business scandals which arise with the disclosure of financial misdeeds by trusted executives of corporations or governments. These days, not too often, these scandals are splashed as headlines across media. Why? Because there are complex groups of stakeholders who might be seriously affected by the scandals. Enron scam was the most remarkable scandal in 20 centuries by their institutionalized, systematic, and creatively planned accounting fraud. The scandal also brought into question the accounting practices and activities of many corporations in the United States. The scandal also affected the greater business world by causing the dissolution of the Arthur Andersen accounting company. This report will reveal the whole story of Enron scam and auditors role from the situation in more depth. It will also include the current situation of those responsible for the fraud. 2. Background of U. S in 1990s The 1990s of U. S were a time of prosperity and this prosperity period is originated from growth in IT corporates and in accordance with increase in productivity as technology develops with IT. In the mid- to late-90s, society’s expectations of what the Internet could offer were unrealistic. Many investors foolishly ignored the fundamental rules of investing in the stock market and instead, investors and entrepreneurs became preoccupied with new ideas that were not yet proven to have market potential. Furthermore, they ignored the blatant signs that the bubble was about to burst. (IT Bubble in 90s) There are two main reasons for the bubble; with investors` optimistic expectation, there were a lot of ‘Window dressing’ in accounting. As Enron collapsed, the growth of the tech sector proved to be illusory, and bubble started to sober. 3. Enron- who are they? Enron Corporation is an energy trading, communications company which was formed in 1985 based in Houston, Texas. Enron marketed electricity and natural gas, delivered energy and other physical commodities. Company branched into many non-energy-related fields as well, including such areas as high-speed Internet bandwidth, and financial and risk management with 21,000 employees at mid-2001. The company reported revenues of $101 billion in 2000. It has stakes in nearly 30,000 miles of gas pipeline, owns or has access to a 15,000mile fiber optic network and has a stake in electricity generating operations around the world. 4. Enron- what they did? The Enron fraud case is extremely complex. There are several main characters who are spearheading the Enron scam. One of them was Jeff Skillng. Jeff Skillng, who was a consultant in Mckinsey, took charge in consulting Enron. He found problems and also potentiality of Enron and he proposed the idea of â€Å"gas bank† to Enron, which is a system that is combining financial system and gas supply and demand system, and taking the margin from the two system(as bank does). This was an ideal idea in theory and Enron asked him to take charge for this business, and later he became the president of Enron’s trading operations. Also, he convinced federal regulators to permit Enron to use an accounting method known as â€Å"mark to market. † Using this method allowed Enron to count projected earnings from long-term energy contracts as current income. This was money that might not be collected for many years. It is thought that this technique was used to inflate revenue numbers by manipulating projections for future revenue. The problem is that it doesn`t match realised profit and real cash flow. especially, Enron`s main trading was long term future contract which is hard to make valuation for the future. Use of these techniques made it difficult to see how Enron was really making money. The numbers were on the books so the stock prices remained high, but Enron wasn’t paying high taxes. When the telecom industry suffered its first downturn, Enron suffered as well. Eventually, the house of cards began falling. When Enron’s stock began to decline, the Raptors began to decline as well. On August 14, 2001, Enron’s CEO, Jeff Skilling, resigned due to â€Å"family issues. † Enron chairman Ken Lay stepped in as CEO. 5. One example of fraud Enron`s â€Å"too much Off-Balance Sheet Transactions† Enron used â€Å"off-balance-sheet†technique for anytime, for many purposes, because it would enable Enron to present itself more attractively as measured by the ratios favored by analysts and investors. Skillng used securitisation to supply more liquidity and also to clean up the assets that is hardly generating income from it. He also hided most of the debt by securitisation. So, Enron needed Special purpose entities(SPE) for the securitization purpose. JEDI was one of the SPE. California PERS and Enron invested by $25000m each. As soon as the JEDI established, Enron started to sell energy related stock to JEDI and it grew JEDI by 23% per year on average. It made Skillng`s ECT business bigger and bigger. 6. Consequences for the stakeholders The key stakeholders affected by the collapse of Enron were its employees and retirees. Stakeholders and mutual funds investors lost $ 70billion market value. Banks were also affected by the meltdown of the company. Not only the stakeholder and bondholder lose out, the confidence in the company also fell. This was the major setback for the company. The actions of Enron management left a deep scare for its 4000 employees which lost out their jobs and also impacted others around them. Some blamed Arthur Andersen; Enron’s accounting firm and some blame the board of directors for insufficient oversights. The damage was so big that it was likely to take years for the court to sort the wreckage. The company did not think of its future and took many bad steps just to earn money. The CEO should have looked into the company matters long time ago and took action so that hundreds of jobs could have been saved. The companies who were associated with the big firm were affected on a very large scale. This was the biggest bankruptcy of a firm with $63. 4 billion in assets. 7. Auditors in this scandal, and their role The external auditing body of Enron company was Arthur Anderson LLP, formerly one of the ‘big 5’ accounting firms, providing auditing, tax, and consulting services to large corporations. Andersen definitely Knew Enron Was in Trouble but they overlooked at it and even conspired with Enron to manipulate the financial statements. They knew Enron was in trouble as early as Feb.  2001, a company memo showed, and Andersen debated dropping the collapsed energy firm all together, Reuters reported. Additionally, Andersen knew in mid-August of a senior Enron employee’s concerns about improprieties in the energy company’s accounting practices. Andersen confirmed that a memo dated Feb. 6 recounted a meeting between Andersen executives about whether Andersen should retain the now-bankrupt Enron as a client. Auditors are responsible directly under the law especially the international standards to report directly to the shareholders on the status of the company’s or a bank’s account at a particular point in time. They heavily misconducted as auditors as they received money and hided about Enron`s truth. 8. Ramifications It is not easy to implement rigorous standards without changing Incentives. This situation can be seen in South East Asian countries like: Singapore, Thailand, Hong Kong, China. Each country can implement its own accounting standards, but did not implement the substantial institutional changes required to make these standards effective. According to various studies conducted in this area, new standards did not result in better-quality financial reporting.9. Conclusion: In search of better standards and ethics The ENRON Scandal is considered to be one of the most notorious within American history; an unofficial blueprint for a case study on White Collar crime. Enron’s behaviour has confirmed that the treatment of off-balance-sheet dodge, American accounting standards are too lax. It is time for another effort to realign the system to function more in shareholders’ interests. Companies need stronger non-executive directors, paid enough to devote proper attention to the job.

Four methods of business communication Written communication: Written communication involves any type of interaction that makes use of the written word. It is one of the two main types of communication, along with oral/spoken communication. Written communication is very common in business situations and they use this type of communication a lot. Written communication includes reports, orders, memos, instructions, rules, policies, agreements, and minutes. Visual Communication: Visual communication is direct face-to-face communication between two or more individuals. Speeches, presentations, discussions, meetings are all forms of oral communication. Face-to-face communication is very easy and useful and you could build a rapport and get people to gain trust in you. Verbal Communication: Verbal communication has more to do with listening than speaking because you are always dealing with an audience. It is one way to communicate with someone face-to-face. Telephone conversations are very useful for this type of communication. People who use verbal communication can share their feelings, thoughts, and emotions by way of them communicating. Staff and students in CCA use this communication every day. Non-Verbal Communication: Non- verbal communication is any kind of communication not involving words. When the term is used, most people think of facial expressions and gestures, but while these are important essentials of nonverbal communication, they are not the only ones. Nonverbal communication can include vocal sounds that are not words such as grunts, sighs, and whimpers. Even when actual words are being used, there are nonverbal sounds such as voice tone, pacing of speech and so forth. When you use non-verbal communication you can use your hands to move them around or your body to get the message across without saying a word. CCA exam results: When students are in year 11 they start to take their GCSE exams in the summer. This will give them opportunities for what they want to use at college or sixth form. However, CCA need to provide students with their results they using a document to present their exam results. After students have taken their exams the exam board will sent a document of all the grades they have achieved in their exams. This document will be given to the students so they know what grade they have got. CCA will provide a certificate to the students who have passed their exam. This certificate will be proof that they have passed it and it can be shown when they apply for sixth forms, colleges or even at a job interview. The document includes the name of the exam they have taken, the board they have taken it in for example EDEXEL or AQA, the exam number, the time of the time, the date of the exam and the duration of the exam. This exam result document will also include all the students’ personal information, for example date of birth and full name. The document is not very attractive; it is just a simple piece of paper that has all the information about the exam. It is very easy and simple to read. There is nothing fancy in the document. However, the certificate CCA make for all students when they pass the example is very attractive and it is made out of very hard paper which shows affection as CCA will put a lot of work just to make one certificate perfect. For CCA to make the exam result documents they had to use couple of methods to make it work. They used web based to make a suitable and presentable design to put on the certificate. Students feel very nervous when they are getting their exam results. They do not mostly care about what it looks like; they just rush to know what grades they got as it can change their life. This is why CCA do not spend much time making these documents as students will not pay attention to anything apart from their grade. The improvement CCA could make would be to make the document more interesting and colourful. This would make the document more interesting and attractive. I think using a document is the right type of method to use as all they are getting is there exam result it does not need to be presented or any other sort. So I personally thing document is the perfect method. For my report above, I have chosen to use a document. The reason for this is because it is a much easier way to present my report out. I think using a report is one of the best methods. This is because it takes less time to use it and it looks very smart and professional without adding any colour objects or font. It is also easier for my teacher to read it. The font is also very clear which means my teacher will not have any problem reading it.

The year 1980 is one to be remembered for the Indian two-wheeler industry, with the roll out of TVS 50, Indias first two-seater moped that ushered in an era of affordable personal transportation. For the Indian Automobile sector, it was a breakthrough to be etched in history. TV S Motor Company is the first two-wheeler manufacturer in the world to be honoured with the hallmark of Japanese Quality – The Deming Prize for Total Quality Management. OBJECTIVES OF THE RESEARCH 1. To analyze the customer satisfaction. 2. To analyze the customer preference. 3. To know which manufacturer is providing better services. 4. To analyze after sales services of bikes. 5. To study the behavioral factors of consumers in motor bikes. 6. To suggest various factors to improve sales. RESEARCH METHODOLOGY It is well known fact that the most important step in marketing research process is to define the problem. Choose for investigation because a problem well defined is half solved. That was the reason that at most care was taken while defining various parameters of the problem. After giving through brain storming session, objectives were selected and the set on the base of these objectives. A questionnaire was designed major emphasis of which was gathering new ideas or insight so as to determine and bind out solution to the problems. DATA SOURCE Research included gathering both Primary and Secondary data. Primary data is the first hand data, which are selected a fresh and thus happen to be original in character. Primary Data was crucial to know various customers and past consumer views about bikes and to calculate the market share of this brand in regards to other brands. Secondary data are those which has been collected by some one else and which already have been passed through statistical process. Secondary data has been taken from internet, newspaper, magazines and companies web sites. RESEARCH APPROACH The research approach was used survey method which is a widely used method for data collection and best suited for descriptive type of research survey includes research instrument like questionnaire which can be structured and unstructured. Target population is well identified and various methods like personal interviews and telephone interviews are employed. SAMPLING UNIT It gives the target population that will be sampled. On the other hand 15 customers do not agree to this fact. While remaining 10 customers are not sure about it. When the customers are asked that are they satisfied with the performance of their bikes then most of them agrees to the fact. Out of the sample size of 90 customers, 55 customers says that they are satisfied with the performance of their bikes. On the other hand 28 customers are not satisfied with the performance of the bikes that they are having. While the remaining 10 customers are unable to say anything. Exclusive powers often impede on judicial review; therefore, judicial review since 1985 forms part of public life. Prior to the establi shment of judicial review, executive actions were not questioned, this impeded on individuals rights4. Establishing judicial review contributes to an increase of cases filed in courts; in essence, there is more clout in terms of the judiciary intervening in unlawful decisions by the public bodies5. However, despite judicial review cutting on executive action, it is subject to abuse. Individual may capitalize on the procedure to delay rulings touching on public policies. Tighter controls should be established, this would help in terms of minimizing piling up of cases in courts and a fast execution of justice. As a specific measure, judicial review should focus on genuine complaints, this assists significantly in holding public bodies’ responsible6. Through the review process, the government is kept at bay regarding enforcement of various public policies7. Challenging decisions arrived by public bodies is important in terms of maintaining balance and check to curb on abuse of p ower. In a case of  Sackett v. U.S. Environmental Protection Agency, for example, the Court unanimously agreed the couple were entitled to an early federal court review of an EPA compliance order declaring that they filled wetlands on their property illegally8.   This process is synonymous with statutory appeal; however, application for court proceedings has a stipulated period, this must not exceed utmost three months. Successful judicial reviews often lead to nullifying the previous decision; therefore, nullifying decisions means, the complainants obtains new ruling favourable to all parties. Regarding the issue of time limits, judicial review applications are endorsed by the court. The first step in the process involves writing a
